浙江省宁波市镇海区是长三角的外贸强区，区内企业正加速布局全球市场。为了帮助区内企业应对国际知识产权风险和挑战，4月10日，在浙江省宁波市镇海区市场监督管理局（知识产权局）、镇海区科学技术局共同指导下，由镇海区知识产权公共服务平台联合宁波市知识产权交易服务中心、镇海区科技市场和宁波甬江科创产业发展有限公司共同主办，北京英创嘉友知识产权代理有限公司（以下简称“英创嘉友”）承办的“国际专利诉讼与海外专利布局”培训成功举办。作为镇海区“426知识产权系列行动”的首发活动，本次培训通过“专家支招+案例推演+政企对话”的创新形式，为30余家科创企业打造国际知识产权攻防实战课。

Zhenhai District of Ningbo City, Zhejiang Province is a strong player in foreign trade within the Yangtze River Delta Area. Local companies are accelerating their global market expansion. To help local companies address international intellectual property risks and challenges, a seminar on "International Patent Litigation and Overseas Patent Strategy" was held on April 10, 2025. Guided by the Zhenhai District Administration for Market Regulation (Intellectual Property Office) and the Zhenhai District Science and Technology Bureau, the event was jointly organized by the Zhenhai District Intellectual Property Public Service Platform, the Ningbo Intellectual Property Exchange Service Center, the Zhenhai District Science and Technology Market, and Ningbo Yongjiang Sci-Tech Innovation Industry Development Co., Ltd. The event was hosted by Innotrack IP Law Firm (“Innotrack”).

镇海区市场监督管理局副局长盛伟刚为本次活动作开幕致辞。盛副局长强调，“知识产权是创新成果的‘护城河’，更是国际竞争的‘战略筹码’“。

Mr. Weigang SHENG, Deputy Director of the Zhenhai District Administration for Market Regulation, delivered the opening speech. He emphasized that “Intellectual property is the ‘moat’ that protects innovation and serves as a ‘strategic asset’ in international competition.”

Session 1 : 美国诉讼体系专利布局策略及风险管理

本次活动特邀美国迈尔斯沃林律师事务所联合创始合伙人、美国专利律师哈里斯·沃林先生以线上同步直播的方式讲授“美国诉讼体系专利布局策略及风险管理”。沃林先生现场拆解美国法院诉讼程序和“337调查”，并针对困局提出“三步防御法则”：诉前预警机制建立、侵权证据链反制策略、ITC终裁救济路径。通过真实判例推演，使参会代表系统掌握了跨境专利战中的攻守要诀。

The event featured Mr. Harris Wolin, Founding Partner of Myers Wolin LLC and U.S. Patent Attorney, who delivered a live online lecture on “Patent Strategy and Risk Management in the U.S. Litigation System.” Mr. Wolin broke down the procedures of ITC investigation and US litigation, proposing the “Three-Step Defense Rule”: establishing a pre-litigation research mechanism, implementing counter-strategies for infringement evidence gathering, and pursuing ITC remedy. Through various case studies, participants gained a comprehensive understanding of key tactics in cross-border patent disputes.

Session 2 : 设计创新的海外专利布局: ‘海牙体系’

结合宁波制造出海特点及面临的“设计易仿制、维权成本高”困境，英创嘉友合伙人及资深专利代理师陈庆超"一图胜千言"。通过实际案例的费用对比，直观展现了“海牙体系”的显著优势。企业可通过单一申请在国际多个缔约方获得15年保护，相较传统途径节约大量成本，为设计创新的全球保护提供了高效、经济的解决方案。

Addressing the specific challenges faced by local companies with global business—such as frequent copycats detected and high enforcement costs— Mr. Qingchao CHEN, who is the partner of Innotrack and senior patent attorney, demonstrated the solution with actual cases comparing expenses and other factors. He vividly illustrated the significant advantages of the Hague System. Companies can obtain protection in multiple contracting countries through a single application for protection up to 15 years. Compared to traditional design applications in multiple jurisdictions, this approach greatly reduces cost and offers an efficient, cost-effective solution for global design protection.
